Terms of Service

1. Acceptance of Terms

By creating an account or using the AboveDeck Services, LLC ("AboveDeck," "we," "us," or "our") platform at abovedeck.us (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

AboveDeck provides a charter compliance and crew management platform, including USCG verification tools, electronic charter agreements, crew network matching, and fleet management features.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use this Service.

4. User Accounts

• You are responsible for maintaining the confidentiality of your password and for all activities under your account.
• You must provide accurate and complete information during registration.
• You may not share your account credentials with others.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of USCG regulations.
• Misrepresent vessel documentation, credentials, or compliance status.
• Harass, abuse, or harm other users through the crew network or messaging features.
• Attempt to access unauthorized data or disrupt the Service.
• Use automated scripts or bots without our written permission.

6. Charter Agreements & Compliance

AboveDeck provides tools for creating and signing charter agreements. You are solely responsible for ensuring your charter operations comply with applicable USCG regulations, including bareboat charter requirements under 46 USC §2101, 6-pack/OUPV limits, and COI requirements for inspected vessels. AboveDeck does not provide legal advice and is not a substitute for legal counsel.

7. Crew Network

The crew network is a matching service. AboveDeck does not employ crew members and is not a party to any agreement between vessel owners and crew. Owners are responsible for verifying crew credentials, conducting background checks, and ensuring compliance with drug testing requirements (46 CFR Part 16) where applicable.

8. SMS & Notifications

If you opt in to SMS notifications, you agree to receive text messages from AboveDeck Services, LLC. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out. Reply HELP for support. Carriers are not liable for delayed or undelivered messages.

9. Intellectual Property

All content, features, and functionality of the Service are owned by AboveDeck Services, LLC and protected by copyright, trademark, and other intellectual property laws.

10. User Content

You retain ownership of content you submit (profiles, vessel photos, agreements). You grant AboveDeck a license to use, display, and process your content as needed to provide the Service.

11. Fees & Billing

Some features require payment (agreement credits, subscriptions). Fees are disclosed at the point of purchase. All fees are non-refundable unless required by law.

12. Limitation of Liability

AboveDeck is provided "as is" without warranties of any kind. To the maximum extent permitted by law, AboveDeck Services, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

13. Indemnification

You agree to indemnify and hold harmless AboveDeck Services, LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may close your account by contacting us.

15. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

16. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
